You are welcome. BTW, Sundial is a big builder, and their service should be up to standard. You'd better understand more from the builder's rep. for the reason why he/she said it is not warrantable.

If you decide to request the conciliation, there is a 120-day waiting period after your submission of form (Year-end form or 2nd year form). Because: If an owner submits a second-year form to Tarion in the second year of the warranty period, the vendor shall have until the end of the 150th day from the date on which Tarion receives the form to repair or resolve the claim items that are listed on the form and that are covered by a warranty. If the vendor does not repair or resolve all of the claim items listed on the second-year form by the 120th day from the date on which Tarion receives the form, the owner may request a conciliation by contacting Tarion at any time between the 121st day and the 150th day, both inclusive. The vendor shall have 30 days after the date of the owner’s request to repair or resolve all of the claim items listed on the second-year form that are covered by warranty.

I think Year-end Form should have the same timeline, you can call Tarion to check if you can request a conciliation now based on your year-end form.     suggested me to hire contract to set up wires to warm up the roof , it could cost a cople of thousands dollars.

    他说, tarion will charge me $50 dollars to do inspection, any idea/ why?

            now the problem is builder ignores my request, it hasn't replied my email yet. I want Tiron to speed up the process to Conciliation. thank you so much for all your help, I will keep you updated

      • Sundial homes. I got reply from Tiron, but not the builder. I guess I have to follow the next step to pay $50 , so Tiron to do an inspection and decide.
        Now I feel that guy wan't that bad as I thought. he told me to do this and try my luck. I guess he is sure it is not covered by warranty, unless Tiron found other flaw on the roof. but regardless, I don't feel good, the big purchase in your life and you have to pay $$$ to fix the problem for a 1.5 year old house.
        I guess the worse case, I have to go to small claim court, if so, do you think I should pay the contractor to fix the problem first then get money back , or don't fix it, ask the court to order them to fix it?

        big mistake, always buy from big name if you can afford. no matter it is house or car.

        • You may try their head office if their site office rep. did not satisfy you. Sometimes different approach may get different result.
          • pay the $50 to do the inpection. otherwise, there is not much chance to get money from your builder no matter how hard you try to "talk" with them
            • I asked Tiron to speed up the process , since I can't leave it leaking for the rest of the winter. the rep told me the ontario building starndard code is too low, in other words, they met the requirement.
            • A qeustion, if Tiron rules out warranty coverage, how much chance you think I can win from the court? the house warrant is less protective than any other merchandise warranty, that's ridiculous. How can they
              tell me that it iis okay you bought a new house and it is leaking, but you can not ask Builder to fix it, you have to fix your new house at your own cost? nobody in my situation can accept that.
