美国是把 ADOPTION 当初 TAX CREDIT,加拿大是当成 DEDUCTION。可以打电话打 CRA 问几次就明白了。

It doesn't matter. the same expense you cannot take the benefit twice. you could elect to put it in a more tax advantage jurisdiction..

Depends. Also mechanically it does not work that way. Like I said, it seems like her husband is still tax resident in Canada. So he will need to report his US income and all associated expenses in Canadian return.Then the US tax payable becomes the Canadian tax credit. So he will get the benefit like you said, assuming he needs to pay higher Canadian tax (without this expense) than US tax.
But otherwise if his husband claims the expense and he is not a tax resident, then he does not need to report his income in Canada. If she is reporting her income in Canada, she cannot claim that expense again, since it was claimed by her husband already.

If you are not tax resident, yes. If you are tax resident, you would report 15000 expense in Canada (if it is higher than that) and 13900 in US, the US total tax payable becomes CA tax credit and you just need to pay the tax differentialTo calculate the right tax differential, you need to report all eligible income and expenses in both countries.

If your husband needs to report his oversea incomes in Canadian tax return, you can still claim this expense. Otherwise no.

谢谢楼上朋友们的回复。我也搞不清tax resident 和 non tax resident的区别,反正我家是这样:每年我先生先报美国税, 再报加拿大的税,在美缴的税都变成加拿大的tax credit, 最后算出还欠加拿大多少税(最少也欠那个健康税)2014年adoption cost 大约有28000刀左右。

Your husband is a tax resident (because you are in Canada). So you need to report the adoption cost in Canadian tax return.

You need to report eligible income/expenses in both countries. Yes. you need to report the adoption cost in both US and Canada, just like you are reporting your income in both countries.

请问一个人可以既是加拿大的tax resident也是美国的tax resident? 我先生两头报税,是不是说明他在美加都是tax resident? 他在美国报税用的是1040表格,没有“NR”字样,谢谢

我个人意见,你在加拿大必须报.作为加拿大居民,你要按照加拿大的税报出来,跟你在美国的税比较,在美国交多了,加拿大税务局不退给你,在美国交少了,补差额给加拿大税务局,是不是?这两边报税是各不相干的,就是说各报各的,最后税务居民这边要按照结果比较来补税.在美国,交税多了肯定不划算,退不回来.交少了,加拿大要补.所以,怎么平衡最合适你们,可以先计算一下.
应该说也没什么好的减税办法,能平衡的就是在美国买类似加拿大RRSP吧.
