枫下家园 / 钱财税务 / 关于First time home buyer的问题:本人2008年和爸妈联名买了房,当时单身未婚。去年老公以他个人名义买了房(之前我们都租房住,他没住过我和父母一起买的那个房子)。在closing时律师说因为我已有房,他虽然第一次买房但也不能享受土地转让税的退税。现在报税时看到HBTC,不知道这个他有资格退税不。看CRA的定义,我的理解是,他四年内都没住过我的房子,可以claim这个HBTC

你老公不符合First time home buyer的定义。 An individual is considered a first-time home buyer if neither the individual nor the individual’s spouse or common-law partner owned and lived in another home in the year of the home purchase or in any of the four preceding calendar years.

看CRA上的定义这么说的:You can claim an amount of $5,000 for the purchase of a qualifying home acquired in 2014,if both of the following apply:
you or your spouse or common-law partner acquired a qualifying home; and
you did not live in another home owned by you or your spouse or common-law partner in the year of acquisition or in any of the four preceding years (first-time home buyer).
我老公,两项都符合啊。除非第二条的那个You,指的是Both of us...

这个tax credit源自2009年的预算。可参考当时对第一次买房人士的定义。没听说这个定义有过改动。

谢谢大侠。算了,老老实实不报了。想想真惨,当初买房是08年底,没赶上好政策,现在又拖累老公...真是两头不划算!
